1. Acceptance of Terms

By using this website, and/or subscribing to a Brick Library plan, you are agreeing to become a User (“User”) or Subscriber (“Subscriber”) and agree to be bound by the terms and conditions of this agreement.

Brick Library may update these Terms and Conditions without prior notice. Users are encouraged to review them regularly (at least each time you access our website and prior to the processing of your next month’s subscription payment).

Continued use of the website or services constitutes acceptance of the updated Terms and Conditions.

BY USING THIS WEBSITE AND PURCHASING ANY PRODUCTS OR SERVICES FROM THE SITE, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. 2. This Agreement

Third-Party Services: If you use third-party services on our website (e.g., payment services), you agree to follow their terms and conditions. In the event of any conflict between the third-party terms and this Agreement, the third-party terms will take precedence.

Enforceability: If any part of this Agreement is found to be unenforceable by a court, the remaining provisions will remain in full effect.

Amendments and Enforcement: Any changes to this Agreement must be made in writing. If we do not enforce any part of this Agreement at any time, it does not waive our right to enforce it in the future. Our failure to act in any instance will not be seen as a waiver of our rights under this Agreement.

Reservation of Rights: We reserve all rights not expressly granted to you in this Agreement.

No Third-Party Rights: This Agreement applies only between you and Brick Library. No third parties have rights under this Agreement.

Assignment: You may not assign or transfer your rights or obligations under this Agreement to anyone else without our written consent. However, we reserve the right to assign or transfer our rights and obligations to third parties, such as in the case of a business sale or legal requirement.

3. Eligibility

You must be at least 18 years old and reside in the United States or the District of Columbia to subscribe to Brick Library.

Brick Library is a COPPA Compliant website and reserves the right to refuse membership to underage users.

You may not register for a subscription if you are under the age of 18 or are not able to form legally binding contracts.

While individuals under the age of 18 may utilize the service, they must only do so under the supervision and with the consent of a parent or legal guardian.

** Some LEGO® sets contain small parts that are NOT suitable for and may pose a hazard to children under 3 years of age. **

4. Dispute Resolution

Any disputes arising out of or related to the use of this website shall be resolved through binding arbitration administered by the American Arbitration Association, in accordance with its Commercial Arbitration Rules, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall take place in the state of Utah. The laws of the State of Utah, without regard to its conflict of law principles, shall govern the interpretation and enforcement of this agreement.

BY USING THIS WEBSITE, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. AS WITH ALL OF THE TERMS & CONDITIONS, YOUR USE OF OUR WEBSITE AND/OR SERVICE ACKNOWLEDGES YOUR UNDERSTANDING AND AGREEMENT TO THIS POLICY.

5. Site Services and Rules

When using Brick Library’s services, you agree to:

  • Provide accurate information when creating an account.
  • Avoid illegal activities or tampering with the website.
  • Respect intellectual property and the rights of other users.
  • Ensure safe and appropriate use of content.

Prohibited activities include but are not limited to:

  • Posting offensive or violent content.
  • Sharing personal information of others without consent.
  • Misusing accounts, spamming, or using bots.


Use of LEGO® Sets

  • Ownership and Care: Once the LEGO® set is delivered to the address you provided, Brick Library is no longer responsible for it. Please note that the set is pre-owned and will be used by others after you. We ask that you treat the LEGO® set with care and respect during your use.
  • Brick Separator Tool: Only use the provided Brick Separator Tool to separate LEGO® pieces. Do not use tools like pliers, tweezers, or your teeth, as this may cause damage to the pieces. Any damaged pieces may result in additional charges, as outlined in the “Penalties & Additional Charges” section.
  • Building and Returning: You are free to build, disassemble, rebuild, and display the LEGO® set for as long as you wish. Once you are finished, please follow the return instructions provided to ensure a smooth return process.


6. User Rights

Safety

  • All users have the right to feel safe when using our site. We are committed to maintaining a secure and welcoming environment.


Communications

  • Any communications made through our contact page, blog, blog comments, newsletter sign-ups, or other pages, or directly to us via phone, mail, or email, are not confidential. These communications may be viewed and distributed by third parties.
  • We reserve the right to own and utilize any communications displayed on our website, servers, or other media as permitted under U.S. law. This includes unsolicited user-generated content, such as blog comments or emails, without credit or royalty payments.
  • For details on how we store and use your communications or any related data, please refer to our Privacy Policy
  • We also reserve the right to republish or distribute any content you upload to our site as part of our business operations. By submitting content, you agree not to include anything that:
    • Is illegal or serves an unlawful purpose.
    • Is potentially libelous, maliciously false, obscene, abusive, negligent, or otherwise harmful or inappropriate.


Responsibility

  • You are fully responsible for all actions taken on the site under your login credentials, including the content you post or comment on.
  • It is your obligation to ensure that any content you share, such as music, images, or other media, belongs to you or is used with proper authorization.
  • If your actions or posts result in fines or penalties, you are solely responsible for covering these costs.

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials on the Site infringe your copyright, the DCMA provides that you (or your agent) may send us a notice requesting that the material be removed or access to it blocked.

The notice must include the following information:

  • The physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works located on the Services are covered by a single notification, a representative list of such works);
  • Identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow Brick Library to locate the material on the Site;
  • The name, address, telephone number, and email address (if available) of the complaining party;
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

8. Intellectual Property

All content included as part of Brick Library services and website, such as text, graphics, logos, images, as well as the compilation thereof, is the property of Brick Library or its suppliers and is protected by copyright and other laws that protect intellectual property and proprietary rights. None of the content found on our website or through using our service may be used for any purpose without our express written consent. Users agree to abide by all applicable copyright and other laws.

9. Third-Party Service Providers

We utilize the services of third-party providers to enhance the functionality and security of our website. By using our website, you acknowledge and agree that we may share certain information (name, birthday, address, phone number, and credit card/ billing information) with the following service providers:

By using our website, you agree to the terms and policies of both Brick Library and the specified third-party service providers.

10. Privacy

Brick Library does not sell, rent, or share subscriber information with third parties for external marketing purposes. We may use subscriber information internally for marketing purposes related to Brick Library services, promotions, and updates. Rest assured, we prioritize the privacy and security of your information. See “Privacy Policy” for more details.

11. Transparent Pricing

We at Brick Library strive to be transparent in our pricing to help you understand what we charge and why. All prices listed below are before taxes, taxes will be calculated at checkout. 

Subscription cost is paid once per month until canceled by the subscriber (see “Returns and Cancellations”)

  • This cost is $24.99 for all users.
  • This grants the user access to “The Library” of our LEGO® sets and makes them a “Member” of our Brick Library service. 


Service fee
is paid per shipment and the price will be posted in “The Library” clearly for each set.

  • In most cases this fee is $9.99 – the only exceptions are listed below.
  • The purpose of this fee is to offset shipping costs and other costs associated with providing this service – which in ALL cases is an expense greater than $9.99. The average cost we incur for shipping is more than $16.00 round trip. 
  • Master Builder sets have a higher fee due to their larger size, higher shipping costs, and the increased purchase cost of these sets. We strive to keep this list as short as possible to maintain affordability for all our customers. (See Prepaid Waitlist police)  
  • The sets that have a service fee higher than $9.99 are as follows:

Pricing Example: When you sign up as a subscriber, you will incur your first monthly payment of $24.99. This will grant you access to “The Library”. From here you can select whichever set you want to pick. If you pick a standard set the service fee for that set would be $9.99. Thus, your total cost for this first set this month would be $34.98. If you build, disassemble, and return that set, then check out another standard set, you will be charged an additional $9.99. Bringing your total cost for the service, for the month to $44.97.

The above prices are prior to any taxes that may be added at checkout. 

Set limits: While you may only check out one LEGO® set at a time, there is no maximum number of sets you can check out per month. You may choose to check out another set as soon as we receive your return. You will be notified via email when we receive your return.

12. Prepaid Waitlist:

To help ensure the process for obtaining the Master Builder sets is as fair and equitable as possible we have created a Prepaid Waitlist for these sets. Customers will pay the rental fee up front to reserve their place in line on the waitlist. The following terms apply to this waitlist:

  • Prepayment and Queue Placement:
    • To secure your place in line for a “Master Builder” LEGO set, you must pay the full rental fee in advance.
    • Once your payment is received, your place in the queue will be confirmed, and you will be notified of your current position in the queue before the payment is processed.
    • You may choose to join the waitlist for multiple sets at the same time. 
  • Non-Refundable Prepayment:
    • The prepayment is non-refundable. Once paid, it cannot be returned, even if you decide to cancel or not rent the set when it becomes available.
    • The prepayment secures your spot in the queue, and we cannot guarantee an exact rental period but will provide an estimate based on demand and availability.
  • Subscription Requirement:
    • To maintain your position in the queue, you must maintain an active subscription with us. If you cancel your subscription before the set becomes available, your place in the queue will be forfeited.
    • Subscription fees will continue as outlined in your account plan. These fees are separate from the prepayment made for the set.
    • You may continue to check out other LEGO sets while you are on the waitlist. 
  • Notification of Queue Status:
    • You will be periodically updated with your position in the queue via email or your account dashboard. We will provide an updated estimate of when the set will be available.
  • Return of Current Set:
    • If you currently have a set rented out and your reserved set becomes available, we will notify you that your reserved set is ready. 
    • You will have 7 days to return your current set. If the set is not returned within that time frame, we will move to the next customer in the queue. (We can discuss alternative options if 7 days is not practical for your specific situation). 
    • If we proceed to the next customer in line due to non-return, your place in the queue for the reserved set will be forfeited.


13. Billing and Payments
:

By subscribing to our service, you acknowledge and agree to these subscription and recurring payment terms:

  • Subscription Plans: By subscribing to our service, you agree to the terms of the selected subscription plan, including the frequency of recurring payments and any associated fees.
  • Automatic Renewal: Your subscription will automatically renew according to the selected plan unless canceled. You may cancel your subscription at any time if you do not currently have a LEGO® set checked out. For more information about canceling your subscription please see the “Returns and Cancellations” section below.
  • Billing Information: You agree to provide accurate and complete billing information, including a valid payment method, and you authorize us to charge the subscription fee to the provided payment method.
  • Billing Cycle: Recurring payments will be charged at the beginning of each billing cycle. The billing cycle is determined by the subscription plan selected.
  • Cancellation: You may cancel your subscription at any time by contacting us. For specific instructions see “Returns and Cancellations” section. 
  • Refunds: Brick Library will not issue refunds for partial or unused portions of a monthly subscription fee. Please make your selection carefully as no refunds are permitted and any cancellations must abide by the “Returns and Cancellations” policy below.
  • Changes to Subscription Terms: We reserve the right to modify subscription plans, pricing, or these terms with reasonable notice. Changes will not affect active subscriptions until the start of the next billing cycle.
  • Contact Information: Please keep your contact and billing information up to date. Failure to do so may result in the suspension or termination of your subscription.

** Brick Library reserves the right to terminate or suspend your subscription for any violation of these terms. **

By creating a subscription account with Brick Library you will provide us with payment information, and authorize us to charge your account a recurring monthly subscription fee. Additional shipping fees, taxes, etc. will be paid upon checkout. 

** A valid credit card is required at all times when a LEGO® set is checked out. **

14. Returns and Cancellations

Returns:

  • Return shipping is covered in the subscription and service fee.
  • Once you have finished with your LEGO® set, you will return it via the shipping carrier on the return label. 
  • The subscriber is responsible for returning the full LEGO® set back to Brick Library in a similar condition as you received it. 
  • Set must be disassembled to the best of your ability. 
    • We understand that some smaller pieces are difficult to pull apart. If you received a set with a few pieces still assembled, you may return them in the same condition. 
  • Pieces must be sorted into the same bags that they arrived in.
  • Set must be returned in the box it arrived in


Failure to return LEGO® sets disassembled, unorganized, or in a different size box will result in an additional charge to your account. See “
Penalties and Additional Charges” section below. Please keep in mind that others are waiting to use the set after you.

Once sets are completely disassembled and organized into the appropriate bag(s), please place sets in the box they arrived in. Place the included prepaid return label over and completely covering the original shipping label. If you have misplaced the return label please email us at admin@brick-library.com for a replacement. You will be notified once we have received your return, and then you may check out your next set.

Cancellations:

You may cancel your subscription at any time if you do not currently have a LEGO® set checked out. Before canceling your subscription, please ensure that you have received an email that we have acknowledged your last return, and you have no other outstanding fees. If you currently have a LEGO® set checked out and you cancel your subscription you will be charged the full retail price of the LEGO® set, plus a restocking fee.

To cancel your subscription please send an email to admin@brick-library.com and we will cancel your subscription for you. We require this communication to ensure all sets have been returned.

15. Gift Certificates

General Use
Gift certificates may be redeemed toward a monthly membership plan on our website. A valid payment method is still required at checkout so your membership can continue once the gift value has been used.

Recipient Responsibility
The recipient of a Gift Certificate is responsible for all the same Terms & Conditions as any other subscriber. To create an account a valid Credit Card will be required. The recipient is responsible for the proper use of the website, safe keeping of the rented set, and payment of any penalties incurred. 

Expiration
All gift certificates expire 12 months from the date of purchase. Unused value remaining after the expiration date is forfeited.

Non-Refundable & Non-Transferable
Gift certificates are non-refundable and cannot be exchanged for cash. They may only be used by the person who redeems the gift code.

Shipping / Service Fee
Gift certificate value applies toward the Membership fee only. Any shipping or handling charges are the responsibility of the member.

Lost or Misused Codes
Treat gift codes like cash. We are not responsible for lost, stolen, or unauthorized use of a code once it has been issued.

One-Time Use
Each code may be redeemed only one time. Once applied, remaining value cannot be split between or transferred to other accounts.

16. Non-Payment Policy

Brick Library reserves the right to pursue the return of the assets or cash equivalent to resolve any debt in addition to the costs associated with any such recovery, including collection fees, if necessary.

In the event of non-payment you will no longer be eligible to check out a set until all debts are settled. We will make every attempt possible to contact you via email, mail, phone calls, and text messages, prior to seeking restitution.

17. Chargeback Policy

Direct Resolution Requirement:
Customers must attempt to resolve any disputes directly with Brick Library before initiating a chargeback with their credit card issuer. We are committed to resolving issues promptly and fairly.

Your failure to read or open email communication from Brick Library does not constitute a failure on our part to resolve an issue. 

Resolution Process:

  • Initial Response: Our customer service team will acknowledge receipt of the dispute within 3 business days and provide an estimated timeline for resolution.
  • Investigation: We will investigate the issue thoroughly, which may include reviewing order details, communication records, and any provided documentation.
  • Resolution Offer: Upon completing the investigation, we will offer a resolution, which may include a refund, replacement, or other appropriate remedy.


Prohibited Chargebacks:

Chargebacks are not permitted under the following circumstances:

  • Disputes Already Resolved: Chargebacks are not permitted for issues that have already been resolved directly with Brick Library.
  • Non-Refundable Items: Chargebacks are not allowed for items or services explicitly marked as non-refundable at the time of purchase.
  • Unauthorized Charges: If unauthorized charges are suspected, customers must notify Brick Library immediately and allow us to investigate before contacting their credit card issuer.
  • Services Delivered: Situations where the service or product was delivered as described, and no material defects or issues were reported to Brick Library.


Consequences of Unauthorized Chargebacks:

  • Account Suspension: Customer accounts may be temporarily suspended pending resolution of the chargeback dispute.
  • Permanent Ban: Repeated or unjustified chargebacks may result in a permanent ban from future purchases with Brick Library.
  • Collection Actions: Brick Library reserves the right to seek reimbursement for chargeback-related losses, including through third-party collection agencies or legal action. Customers may also be responsible for additional fees associated with dispute resolution or recovery efforts.


Acknowledgment of Policy:

By completing a purchase, customers acknowledge and agree to abide by this policy. Initiating a chargeback without attempting to resolve the issue directly with Brick Library may result in the actions described above.

18. Penalties and Additional Charges

**In all cases, communicating with us will allow us to provide the most leniency possible, up to and including no penalty or no additional fees due** 

If something happens to a set, please contact us at admin@brick-library.com and we will find a fair and favorable remedy as soon as possible.

Missing or Lost Parts: If, upon return of a LEGO® set, it is determined in our sole and reasonable discretion that certain parts are missing or lost, the following policy will apply:

  • Generally, if the lost parts account for less than 15 grams of total weight, no cost will be passed on to the subscriber. However, we reserve the right to collect the replacement cost of each missing or lost part at our discretion on a case-by-case basis. 
  • The cost will be determined based on the replacement price of the individual LEGO® pieces.
  • Brick Library will provide subscribers with a detailed list of the missing or lost parts and associated replacement costs.
  • Replacement costs are generally higher for specialty parts or Minifigures
  • In some cases, these parts cannot be replaced, in this case you will be charged the full replacement (or current sale) value of the whole set. 
  • The replacement cost will be charged separately to the customer’s payment method on file or the subscriber will be sent an invoice to cover these fees.
  • Subscribers are encouraged to thoroughly inspect and account for all parts before returning the LEGO® set to avoid any additional charges.


Failure to Disassemble:
Upon return, Subscribers are expected to disassemble the LEGO® set and return the parts to the packaging they arrived in. Failure to disassemble the set may result in the following:

  • Occasionally a small number of parts may be difficult to disassemble. In the event this rarity occurs, please send the affected parts back to us and notify us via email of the LEGO® bricks you were unable to disassemble (should be less than 5% of the parts) and we will attempt to use our resources and at our own risk disassemble them. 
  • If we are not notified or if the assembled parts represent more than a small portion of the set (more than 5% or the parts) a disassembly fee will be applied to cover the time and labor required to disassemble the set.
  • The disassembly fee will be charged separately to the Subscriber’s payment method on file or the subscriber will be sent an invoice to cover these fees.
  • Subscribers are encouraged to follow the provided disassembly instructions to avoid any additional charges.


Damaged Product:
If a LEGO® set is returned with damage, the following policy will be enforced:

  • Damage includes, but is not limited to:
    • Cracked, bent, or broken parts
    • Smoking or other offensive odors
    • Yellowing / sun damage
  • Subscribers are responsible for the repair or replacement costs of any damaged parts or sets.
  • Brick Library will assess the extent of the damage and provide Subscribers with a detailed list of the damaged parts and associated repair or replacement costs.
  • The repair or replacement costs will be charged separately to the customer’s payment method on file or the subscriber will be sent an invoice to cover these fees.
  • Subscribers are encouraged to handle LEGO® sets with care to avoid any additional charges.


Failure to Return Set:
If a Subscriber fails to return a rented LEGO® set or cancels their payment method prior to returning a reserved LEGO® set, the Subscriber may be charged the full retail price of the LEGO® set and fees associated with the time spent and collections process. 

Subscribers are responsible for communicating any issues or delays in returning the set to avoid additional charges.

Lost or Stolen Sets: Upon delivery, it is the subscriber’s responsibility to ensure the safety of the LEGO® set. Once the shipping carrier confirms that the package has been delivered, you assume responsibility for its protection. Loss, theft, or damage after delivery may result in charges for the full replacement value and any additional restocking fees.

Collections: 

You are subject to any collections procedures that Brick Library chooses to institute for any past due amounts owed. You agree to pay Brick Library’s collection costs, including but not limited to attorneys’ fees. Amounts owed can be calculated through monthly payments as well as the cost of any missing items from your orders that have not been paid for.

We will make every attempt to contact you to resolve any debts directly prior to submitting any claims in an outside collections process. 

Chargebacks:

If you fail to follow our Chargeback Policy you are responsible to cover the cost of any penalties Brick Library receives. See “Chargeback Policy”.

Admin & Restocking Fees

In addition to the penalties and charges described above, a restocking fee of $50 will be charged to cover the cost of our time and expenses in documenting, recovering, and replacing parts or sets. If the time required exceeds 1 hour, this fee will increase at a rate of $50/hour. You will be provided with a breakdown of these costs and efforts in the event this becomes necessary.

19. Shipping and Delivery

    • Shipping Method & Tracking: All LEGO® sets are shipped via a standard shipping carrier, and tracking information will be provided once your order is dispatched.
    • Responsibility for Set Safety: Upon delivery, it is the subscriber’s responsibility to ensure the safety of the LEGO® set. Once the shipping carrier confirms that the package has been delivered, you assume responsibility for its protection. Loss, theft, or damage after delivery may result in charges for the full replacement value and any additional restocking fees. For more details, refer to the “Penalties & Additional Charges” section.
    • Shipping Fees: A standard service fee of $9.99 will be applied for most LEGO® sets. Larger Master Builder sets, which require larger packaging, will have a higher shipping fee. This fee covers shipping in both directions. Please refer to the “Transparent Pricing” section for a breakdown of these costs.
    • Delivery Timeframe: Shipping is typically completed within 2-5 days. You will receive an email with tracking information once your set is shipped. Each package will also include a prepaid return shipping label for your convenience when you are ready to return the set.
  • Non-Delivery & Lost Packages: Brick Library does not guarantee delivery of LEGO® sets. If a package is lost by the mail provider, we are unable to issue a refund. However, if you report a non-delivery and we can verify the issue, you may not be held responsible for the replacement.


20. Product Condition

  • Quality Assurance: We carefully inspect and prepare all LEGO® sets to ensure they are clean and in good condition before shipment. Please keep in mind that these sets have been used by previous subscribers, so some general wear and tear may be present. We aim to provide a high-quality product with every delivery.
  • Missing or Damaged Pieces: If you notice any damaged or missing pieces upon receiving your set, please notify us immediately at admin@brick-library.com. Failure to report missing pieces could result in you being held responsible for replacement costs, as outlined in the “Penalties and Additional Charges” and “Damaged Pieces” sections.
  • Piece Organization: LEGO® sets are organized to make building easier. Some pieces may be sorted by color, while others may be grouped by the steps in the building process. Specialized pieces such as minifigures or pieces with stickers may be separated into individual bags. All sets will be labeled to help ensure a smooth building experience.


21. Disclaimer, Safety, and Limitations of Liability

By subscribing to Brick Library, you agree to the following terms regarding liability, safety, and the use of our LEGO® sets:

No Liability for Harm or Damage:

  • Brick Library is not liable for any harm or damage related to the goods, services, or content, nor for the use of the products we supply.


Inventory and Availability

  • Brick Library’s inventory is constantly changing. There may be times when certain LEGO® sets are out of stock. Subscribers may request a set by emailing us at admin@brick-library.com. LEGO® sets that were previously available may be removed from rotation without notice.


Age Restrictions and Adult Supervision

  • LEGO® sets are intended for individuals over the age of 18. We strongly recommend adult supervision if you permit children to use our LEGO® sets, particularly for younger users. Adults should monitor play closely to prevent accidents or injuries.


Choking Hazard Warning

  • Some LEGO® sets contain small parts that may pose a choking hazard, especially for children under 3 years old. 
  • These sets are sorted into plastic resealable bags, and it is the responsibility of the user to keep these bags out of the reach of small children.
  • Exercise caution and always ensure appropriate supervision. Do not leave children unattended.


Battery Hazard Warning:

  • INGESTION HAZARD: Some LEGO® products may contain a button cell or coin battery.
  • DEATH or serious injury can occur if ingested.
  • A swallowed button cell or coin battery can cause INTERNAL CHEMICAL BURNS in as little as 2 HOURS
  • KEEP new and used batteries OUT OF REACH OF CHILDREN
  • SEEK IMMEDIATE MEDICAL ATTENTION if a battery is suspected to be swallowed or inserted inside any part of the body.


Product Liability Limitation

  • Brick Library is not liable for any injuries, damages, or losses resulting from the use or misuse of our LEGO® sets. By using our products, users acknowledge this limitation of liability.

Prompt Reporting

  • Users or their guardians must promptly report any injuries, incidents, or safety concerns related to the use of our LEGO® sets. Please send any concerns to admin@brick-library.com.


Assumption of Risk:

User hereby accepts, and assumes responsibility for, each of these risks and dangers described here, and all other risks and dangers that could arise out of, or occur during, your use of the products and services offered through the Site.

RELEASE AND WAIVER: 

USER HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE COMPANY, THEIR OFFICERS, EMPLOYEES, OR CONTRACTORS, (COLLECTIVELY, THE “RELEASEES”), FROM AND FOR ANY LIABILITY RESULTING FROM ANY PERSONAL INJURY, ACCIDENT OR ILLNESS (INCLUDING DEATH), AND/OR PROPERTY LOSS, HOWEVER CAUSED, ARISING FROM, OR IN ANY WAY RELATED TO, USER’S CONTACT WITH THE PRODUCTS AND SERVICES OFFERED THROUGH THE SITE.

USER AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS BRICK LIBRARY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, THIRD PARTIES, AND THE RELEASEES FROM ANY AND ALL CLAIMS, ACTIONS, SUITS, PROCEDURES, COSTS, EXPENSES, DAMAGES, AND LIABILITIES, INCLUDING, BUT NOT LIMITED TO, ATTORNEY’S FEES, ARISING FROM, OR IN ANY WAY RELATED TO, USER’S USE OF THE PRODUCTS AND SERVICES OFFERED THROUGH THE SITE. USERS AND SUBSCRIBERS AGREE TO PAY ANY AND ALL COSTS, DAMAGES, AND EXPENSES RELATING TO OR ARISING OUT OF THEIR USE OF OUR SITE AND SERVICES.

Severability: 

User understands this agreement is intended to be as broad and inclusive as is permitted by the law of the relevant jurisdiction and that if any portion is held to be unenforceable, then that provision will be modified to the minimum extent necessary to make it enforceable, unless that modification is not permitted by law, in which case the provision will be disregarded. User agrees that if an enforceable provision is modified or disregarded in accordance with this section, then the rest of the agreement will remain in effect as written and that any unenforceable provision will remain as written in any circumstances other than those in which the provision is held to be unenforceable.
